Important - Services for Professionals Only

The services offered by Backlink Eldorado are exclusively intended for professionals (legal entities or natural persons acting within the scope of their professional, commercial, artisanal or liberal activity).

By using our services, you declare that you are acting for purposes that fall within the scope of your professional activity. These T&Cs are governed by commercial law and provisions relating to contracts between professionals.

Article 2 - Purpose and Scope

These Terms and Conditions of Sale (hereinafter "T&Cs") govern all commercial relations between THE DUG MEDIA LTD and its professional clients.

Any order implies unreserved acceptance of these T&Cs, which prevail over any other document, including the client's general purchasing conditions.

The services offered include:

Buying and selling backlinks
Trust Flow (TF) boost services and SEO metrics
Sponsored article publication
SEO service subscriptions and packages
Access to analysis and research tools

Article 3 - Prices and Payment Terms

3.1 Prices

Prices are indicated in euros and are exclusive of taxes (excl. VAT). Applicable VAT will be added at the time of invoicing according to the rate in force.

THE DUG MEDIA LTD reserves the right to modify its prices at any time. Services will be invoiced based on the rates in effect at the time of order validation.

3.2 Payment Terms

Payment is made in full at the time of order by credit card through our secure payment provider Stripe.

For subscriptions, payment is automatically debited at each due date according to the chosen periodicity (monthly or annual).

3.3 Late Payment

Any late payment automatically results in:

Application of late payment penalties calculated at a rate of 1.5% per month of delay
A flat-rate compensation for recovery costs of €40
Immediate suspension of ongoing services

Article 4 - Order and Service Execution

4.1 Placing an Order

The order is deemed accepted after payment validation. A confirmation email is sent to the client summarizing the order details.

4.2 Execution Deadlines

Execution deadlines vary according to the nature of the services:

SEO Boosts: processing within an indicative period of 7 to 30 business days
Article publication: depending on publisher availability, generally within 15 to 45 days
Tool access: immediate after payment validation

These deadlines are given as an indication and do not constitute a firm commitment. Exceeding them cannot give rise to order cancellation or compensation.

4.3 Client Obligations

The client agrees to:

Provide accurate and complete information
Provide necessary content within agreed deadlines
Respect communicated guidelines and best practices
Not use services for illegal purposes

Article 5 - No Right of Withdrawal

As these T&Cs are exclusively addressed to professionals, the right of withdrawal provided for consumers does not apply.

Consequently, no right of withdrawal is granted to the professional client. Any validated order is firm and final.

Article 6 - Cancellation and Refund

In the absence of a right of withdrawal, refunds are only granted in the following cases:

Total non-execution of the service attributable to THE DUG MEDIA LTD within 60 days
Major non-compliance of the service with the description
Definitive technical impossibility to execute the service

Any refund request must be sent by email to contact@backlink-eldorado.fr within a maximum of 30 days following the scheduled execution date of the service.

Purchased credits are non-refundable and remain valid for the duration of the client's active subscription.

Article 7 - Subscriptions

7.1 Duration and Renewal

Subscriptions are taken out for a monthly or annual period depending on the offer chosen. They are automatically renewed by tacit renewal at each due date.

7.2 Termination

The client can cancel their subscription at any time from their client area. Cancellation takes effect at the end of the current period.

In case of cancellation:

The client retains access to services until the end of the paid period
No pro rata refund is made
Unused credits remain available until the end of the current period

7.3 Annual Subscriptions - No Refund

Annual subscriptions (all services combined, including SEO metrics boost services such as Trust Flow, Domain Authority, Domain Rating) are non-refundable under any circumstances.

By subscribing to an annual subscription, the client expressly accepts that:

No refund, even partial or pro rata, will be made regardless of the reason given
The resale, transfer or assignment of the website benefiting from the service does not entitle to any refund
The client's cessation of activity or closure of their site does not entitle to any refund
Any modification of algorithms or calculation methods of third-party tools (Majestic, MOZ, Ahrefs, etc.) making artificial improvement of metrics impossible constitutes force majeure not giving rise to any refund

Article 8 - Warranties and Limitations

8.1 Nature of Services

Netlinking and SEO services constitute best-efforts obligations and not obligations of result. THE DUG MEDIA LTD undertakes to implement the means necessary for the proper execution of services but does not guarantee:

A specific ranking in search engines
A guaranteed increase in Trust Flow or other metrics
Indexing of links by search engines
A specific timeframe for seeing SEO improvements

8.2 SEO-Related Risks

The client acknowledges being informed that netlinking practices involve inherent risks, particularly with regard to search engine guidelines. THE DUG MEDIA LTD cannot be held responsible for any penalties applied by search engines.

8.3 Prohibited Uses of Boost Services

It is strictly prohibited to use Trust Flow (TF) boost services or any other SEO metric to improve a website that would itself serve as a "booster" intended to boost the metrics of other personal sites of the client.

By subscribing to a boost service, the client certifies that the beneficiary site is a final site with commercial, editorial or informational purposes, and not an intermediary in a metrics optimization chain.

THE DUG MEDIA LTD implements automated detection systems to identify abusive usage patterns, including:

Sites with abnormal outbound link patterns to other domains of the same owner
Sites whose backlink profile suggests use as an authority relay
Networks of interconnected sites belonging to the same client

In case of detection of such fraudulent use, THE DUG MEDIA LTD reserves the right to immediately and without notice interrupt the boost service, without any refund, even partial, being due to the client.

Article 9 - Liability

THE DUG MEDIA LTD's liability is expressly limited to the amount excl. VAT actually paid by the client for the service concerned.

Under no circumstances can THE DUG MEDIA LTD be held liable for:

Indirect damages, such as loss of revenue, loss of customers, loss of data, damage to image
Consequences of non-compliant use of services
Erroneous information provided by the client
Search engine decisions (demotion, penalties, deindexing)
Temporary unavailability of services for maintenance

Article 10 - Intellectual Property

The client remains the owner of the content they provide for publication. They guarantee that they hold all necessary rights to this content and release THE DUG MEDIA LTD from any liability in case of violation of third-party rights.

The tools, methods, software and databases developed by THE DUG MEDIA LTD remain its exclusive property.

Article 11 - Confidentiality

Each party undertakes to keep confidential the information of the other party that they may become aware of in the course of the execution of the services, for a period of 2 years after the end of the commercial relationship.

Article 12 - Personal Data

THE DUG MEDIA LTD collects and processes personal data in accordance with GDPR and its Privacy Policy accessible at: https://backlink-eldorado.fr/en/privacy-policy

Article 13 - Force Majeure

Neither party shall be held liable for non-performance of its obligations in case of force majeure, i.e., any event beyond the control of the parties, unforeseeable and insurmountable.

The following are notably considered force majeure events: natural disasters, wars, strikes, internet network failures, government decisions, pandemics.

Special case of SEO metrics boost services

The following are also expressly considered force majeure events, concerning SEO metrics boost services (Trust Flow, Domain Authority, Domain Rating, Referring Domains):

Any modification of algorithms or calculation methods of third-party tools (Majestic, MOZ, Ahrefs, SEMrush, etc.)
Any technical update making artificial improvement of metrics impossible or ineffective
Any decision by the publishers of these tools aimed at detecting or neutralizing metrics improvement techniques
The cessation, suspension or substantial modification of the services of these third-party tools

These events being completely beyond the control of THE DUG MEDIA LTD, they cannot under any circumstances give rise to a refund, even partial, of ongoing subscriptions.

Article 14 - Modification of T&Cs

THE DUG MEDIA LTD reserves the right to modify these T&Cs at any time. Modifications take effect upon their publication on the site.

For ongoing subscriptions, the new T&Cs apply from the next renewal. The client who does not accept the new conditions can cancel their subscription before its renewal.

Article 15 - Applicable Law and Jurisdiction

These T&Cs are governed by Cypriot law.

In case of dispute relating to the interpretation or execution of these T&Cs, the parties will endeavor to find an amicable solution.

Failing amicable agreement, exclusive jurisdiction is attributed to the courts of Larnaca (Cyprus), even in case of multiple defendants or third-party claims.

Article 16 - Miscellaneous Provisions

If any clause of these T&Cs is declared null, it shall be deemed unwritten but shall not invalidate the other clauses.

The fact that THE DUG MEDIA LTD does not invoke a breach by the client of any of its obligations shall not be interpreted as a waiver of the obligation in question.
